Insurance Requirements for Technology Contracts | BCN HR shared services


Network Security / Privacy (Cyber) and Technological Errors and Omissions (Tech E&O) coverage is required for contracts under $ 1,000,000 to a minimum limit of $ 5,000,000 per event.

Higher limits will apply if the vendor provides critical software / support to the Nevada System of Higher Education (NSHE), University of Nevada, Reno (UNR) or if technology contracts exceed $ 1,000,000. The insurance limits for these contracts are established and approved by the risk management office.

Suppliers and / or its subcontractors agree at its own expense to maintain the following insurance coverage with insurance companies acceptable to the customer at the sole discretion of the customer with a rating of at least A by Best’s Insurance Guide.

Technological errors and omissions

E&O technology applicable to the services provided, at a minimum, includes (1) systems analysis (2) systems programming (3) data processing (4) systems integration (5) outsourcing, including including outsourcing of development and design (6) design, consulting, systems development and modification (7) training services relating to computer software or hardware (8) management, repair and maintenance of products, networks and computer systems (9) marketing, sales, servicing, distribution, installation and maintenance of computer hardware or software (10) data entry, modification, verification, maintenance, storage, retrieval or preparation for the output of data , and any other service provided by the supplier.

Tech E&O insurance must cover liability and claim costs resulting from errors, omissions or negligent acts in the performance or failure to provide IT or IT services and technology products; this coverage should also cover punitive damages, software copyright infringement, rendering or failure to render any services, and the supply of any goods in connection with the performance of the contract, including failure to render any -respect by the products of the intended function or the intended objective .

Network security / privacy (cyber)

If the provider’s services provide direct access to the Nevada System of Higher Education (NSHE), University of Nevada, Reno (UNR) systems or hold sensitive information, including cloud-based, from NSHE / UNR, then the Security / Privacy network (Cyber) coverage must be provided as part of the technological E&O coverage:

  1. The cyber policy must include coverage for loss, disclosure and theft of data in any form; media and content rights infringement and liability, including, but not limited to, software copyright infringement; Network security failure including, but not limited to denial of service attacks and malicious code transmission. Coverage includes regulatory fines and penalties for a data breach, the cost of notifying individuals of a security or data breach, the cost of credit monitoring services, and any other causal crisis management expense during a maximum period of one (1) year. The cover must contain severability for the insured organization for any exclusion of intentional act. If this coverage is provided on the basis of a claim, it must be maintained for a period of two (2) years after acceptance of the deliverables and / or services provided under this Agreement.
  2. In addition, such a policy will cover indirect or indirect liabilities, and Nevada System of Higher Education, University of Nevada, Reno will be named “additional insured”, with an amendment allowing the “additional insured” to file a claim against the named insured.

Insurance requirements for media contracts

Media liability coverage is required for providers providing content for website design, social media, marketing, advertising, graphics, text, etc.)

Media liability insurance, including coverage for intellectual property infringement, invasion of privacy, plagiarism, advertising and content infringements and defamation, unauthorized disclosure of data, direct loss coverage or indirect and punitive damages with limits of 1,000,000 USD.
